THEATRE CAMP PARTICIPANT AUTHORIZATION, RELEASE AGREEMENT, AND PAYMENT POLICY
PLEASE READ CAREFULLY BEFORE SIGNING
Waivers of Liability and Indemnification:
1. Participant understands that there are inherent and other risks, both known and unknown, involved in theater production and education, and that injuries are a common and ordinary occurrence of theater production, and Participant freely and voluntarily assumes those risks. Participant agrees to be legally responsible for any and all damage, injury or death to myself or other persons or property that results from the inherent risks in this camp. Participant understands that OSTC is not required to eliminate, alter or control the inherent risks or other risks within the camp.
2. Participant hereby agrees to take full responsibility for, and does hereby release, discharge and hold harmless, OSTC, its Board of Directors, staff, volunteers, performers, company members, managers, operators, officers, directors, employees, and agents, as well as the Center For The Arts, its Board of Directors, staff, volunteers, managers, operators, officers, directors, employees, and agents for any and all loss or damage, including any loss or damage that results from claims for personal injury, death, or property damage in any way arising from or related to related to Participant’s participation in the camp.
3. Participant hereby agrees to and does indemnify and release from liability OSTC, its Board of Directors, staff, volunteers, performers, company members, managers, operators, officers, directors, employees, and agents, as well as the Center For The Arts, its Board of Directors, staff, volunteers, managers, operators, officers, directors, employees, and agents (“Indemnitees”) from any and all demands, claims, suits, and expenses, including but not limited to reasonable attorney’s fees (“Claims”), which one or more of the Indemnitees may incur by reason of Participant’s negligent acts or omissions arising out of or in connection with the camp.
4. This Agreement constitutes the entire agreement and understanding between the parties and supersedes all prior and contemporaneous agreements, whether oral or written. It is and shall be governed by and construed in accordance with the laws of the State of Wyoming; any action brought under this Agreement shall be brought in exclusive jurisdiction thereof will be in the State or Federal Courts of the State of Wyoming; and the prevailing party shall be entitled to all costs, including reasonable attorneys’ fees, incurred to enforce its rights hereunder.
Payment and Cancellation Policy:
1. I, the undersigned, voluntarily and having been informed of the nature of the program which Off Square Theatre Company provides, assume full responsibility for my/my child’s participation. I hereby release Off Square Theatre Company, its Board of Directors, staff and volunteers from any and all causes of action for personal injury and/or property damage resulting from my/my child’s participation in Off Square Theatre Company activities.
2. I do hereby authorize Off Square Theatre Company to publish names and/or any photographs taken of me/my child for use in printed publications, website, or other marketing venues. I acknowledge that participation is voluntary and I/my child will not receive financial compensation for use of such photographs. I further release Off Square Theatre Company from any claims by me or any third party in connection with my participation by me/my child.
3. I agree to take full responsibility for payment of my/my child’s tuition. Your child’s space is not confirmed until OSTC has received payment. Cancellations up to 14 days prior to the event will receive a full refund. Cancellations within 14 days of the event will receive a 50% refund. Cancellations within 72 hours of the beginning of the event or during the event's duration will not receive a refund. Class reservations are transferable subject to OSTC’s approval. I have read and understand the cancellation policy.
4. Students with fees that are past due (+15 days) and have not established a payment plan will be placed in bad standing until their financial obligation has been resolved. A student in bad standing will not have a spot held in the program and will not be allowed to participate in classes, rehearsals, or performances. We ask families to communicate directly with us promptly to work out any financial issues. We do not want to be put in a position to not allow a student to attend class/rehearsal or perform.
5. Scholarships are available for all OSTC youth education programs and are valid for any programs that take place within the calendar year of their initial approval. Scholarships are typically 50% of tuition.
I hereby affirm that I am at least 18 years of age and that I have read, understand and agree to be legally bound by the terms of this Agreement.
