PARTICIPANT RELEASE
PLEASE READ CAREFULLY BEFORE SIGNING
As a participant in one or more programs or productions of Off Square Theatre Company’s (“OSTC”), the individual below (the “Participant”) hereby freely and voluntarily agrees through his or her signature (or, if a minor, through the signature of his or her parent) to the following:
1. I understand that there are inherent and other risks, both known and unknown, involved in theater production, set construction, and related performance, and that injuries are a common and ordinary occurrence, and I freely and voluntarily assume those risks.
2. On my own behalf, and for my parents, spouses, heirs, representatives, employees, agents, and/or assigns, I agree to be legally responsible for any and all damage, injury or death to myself or to other persons or property that may result from my (or my child’s) participation in any OSTC program and/or production and the inherent risks associated with the same.
3. On my own behalf, and for my parents, spouses, heirs, representatives, employees, agents, administrators, and/or assigns, I agree to take full responsibility for, and hereby release, discharge and hold harmless, OSTC, its Board of Directors, staff, volunteers, performers, company members, managers, operators, officers, directors, employees, independent contractors, and agents, as well as the Center For The Arts, its Board of Directors, staff, volunteers, managers, operators, officers, directors, employees, independent contractors, and agents, for any and all claims, demands, loss, and/or damage, including any loss or damage that may result in personal injury, death, or property damage, in any way arising from or related to related to my (or my child’s) participation in any OSTC program and/or production.
4. On my own behalf, and for my parents, spouses, heirs, representatives, employees, agents, and/or assigns, I hereby indemnify OSTC, its Board of Directors, staff, volunteers, performers, company members, managers, operators, officers, directors, employees, independent contractors, and agents, as well as the Center For The Arts, its Board of Directors, staff, volunteers, managers, operators, officers, directors, employees, independent contractors, and agents (“Indemnitees”) from any and all demands, claims, suits, and expenses, including but not limited to claims for attorney’s fees (“Claims”), which one or more of the Indemnitees may have or incur by reason of my (or my child’s) intentional or negligent acts or omissions in any way arising from or related to my (or my child’s) participation in any OSTC program and/or production.
5. I hereby grant OSTC permission to take photographs and/or video or me (or my child) and to utilize and/or publish my (or my child’s) image for promotional/advertising purposes.
I hereby affirm that have read, understand and agree to be legally bound by the terms of this Participant Release.
